Access to Temple Beth El Wireless Service  

We hope you enjoy the wireless access service provided by Temple Beth El.

Temple Beth El (“TBE”) Wireless Wi-Fi Internet Access Terms, Conditions, Limitations and Disclaimers including Indemnification and Hold Harmless Agreement:

· Wireless Wi-Fi Internet Access is provided to TBE Members and authorized TBE visitors as a courtesy service free of charge on an “as is” / ”where is” basis with no guarantee and no warranty. It is understood and agreed that the service may be interrupted at any time without notice or warning.

· By using the TBE Wireless Wi-Fi network, the user represents and warrants that he/she is at least 18 years old and is a member of TBE or an authorized visitor on TBE premises.

· Any user does so in his/her sole discretion. In no event will TBE, its officers, members or its employees be liable for any incidental, indirect, special, punitive, exemplary, or consequential damages, arising out of your use of or inability to use the wireless wi-fi internet access network, including without limitation, loss of revenue or anticipated profits, loss of goodwill, loss of business, loss of data, computer failure or malfunction, or any other damages.

· Information passing through the TBE wireless access is not secured and could be monitored, captured or altered by others. It should be assumed by users that their use of the wireless service is unsecured in all respects.

· It is the user’s sole responsibility to protect his/her information from all risks associated with using the Internet, including any damage, loss or theft that may occur as a result of his/her use of TBE wireless internet access.

· TBE staff is not able to provide technical assistance and assumes no
responsibility for laptop configurations, security or changes to data files resulting
from connection to the TBE wireless internet network.

· TBE assumes no responsibility for the safety of equipment; therefore users must keep their equipment with them at all times and may only use designated electrical outlets at public tables.

· TBE further assumes no responsibility for protecting users or their equipment from hazards arising from use of the internet including viruses, cookies, spyware, and/or malware of any kind or nature as well as the risk of identify theft or theft of personal information. Users are solely responsible for maintaining any software required to protect the user from these hazards as well as for using judgment in the use of the service to protect themselves from such hazards.

· While using this wireless access, users acknowledge that they are subject to,
and agree to abide by all applicable Federal, State and Local laws, rules and regulations including but not limited to those pertaining to copyright and intellectual property.

· At its sole discretion, TBE may terminate this service at any time without prior notice.

· Printing is not available via the wireless connection.

Acceptable Use of the Service

A user’s access to the service is conditioned on legal and appropriate use of the service. A user’s use of the service and any activities conducted online through the service shall not violate any applicable law or regulation or the rights of TBE or any third party. In addition, and not by way of limitation, the use of the service for the following activities is specifically prohibited.

Spamming and Invasion of Privacy

Sending of unsolicited bulk and/or commercial messages over the Internet using the service or using the service for activities that invade another’s privacy.

Intellectual Property Right Violations

Engaging in any activity that infringes or misappropriates the intellectual property rights of others, including patents, copyrights, trademarks, service marks, trade secrets or any other proprietary right of any third party.

Obscene or Indecent Speech or Materials

Using this service to advertise, solicit, transmit, store, post, display or otherwise make available obscene or indecent images or other materials. TBE will notify and fully cooperate with law enforcement if it becomes aware of any use of service in any connection with child pornography or the solicitation of sex with minors.

Defamatory or Abusive Language

Using the service to transmit, post, upload or otherwise making available defamatory, harassing, abusive or threatening material or language that encourages bodily harm, destruction of property or harasses another.

Forging of Headers

Forging or misrepresenting message headers, whether in whole or in part, to mask the originator of the message.

Hacking

Accessing illegally or without authorization computers, accounts, equipment or networks belonging to another party, or attempting to penetrate security measures of another system. This includes any activity that may be used as a precursor to an attempted system penetration, including, but not limited to, port scans, stealth scans or other information
gathering activity.

Distribution of Internet Viruses, Trojan Horses, or Other Destructive Activities

Distributing information regarding the creation of and sending Internet viruses, worms, Trojan Horses, pinging, flooding, mail bombing or denial of service attacks. Also, activities that disrupt the use of or interfere with the ability of others to effectively use the node or any connected network, system, service or equipment.

Facilitating a Violation of this Agreement of Use

Advertising, transmitting or otherwise making available any software product or service that is designed to violate this Agreement, which includes the facilitation of the means to spam, initiation of pinging, flooding, mail bombing, denial of service attacks and piracy of software.

Export Control Violations

Transferring technology, software or other materials in violation of applicable export laws and regulations, including but not limited to the U.S. Export Administration Regulations and Executive Orders.

Other Illegal Activities

Using the service in violation of applicable law and regulation, including, but not limited to, advertising, transmitting or otherwise making available pyramid schemes, fraudulently charging credit cards, pirating software or making fraudulent offers to sell or buy products, items or services.

Resale

The sale, transfer or rental of the service, either directly or as part of a service or product created for resale.

INDEMNIFICATION AND HOLD HARMLESS:

USER AGREES TO INDEMNIFY AND HOLD HARMLESS TBE AND ITS MEMBERS, OFFICERS AND EMPLOYEES TO THE MAXIMUM EXTENT ALLOWED BY LAW FOR ANY LOSS, CLAIM OR DAMAGE, INCLUDING CLAIMS ASSERTED BY THIRD PARTIES OR ENTITIES, ARISING OUT OF THE USE OF THE TBE WIRELESS WIFI ACCESS SERVICE INCLUDING BUT NOT LIMITED TO ACTUAL ATTORNEYS FEES AND COSTS OF DEFENSE INCURRED IN DEFENDING AGAINST ANY SUCH CLAIM.
